Wind Machines

 

Study Purpose and Scope

Wind machines - removing a barrier:

The City and County zoning codes currently require that a "wind energy conversion system" (also known as wind turbines, wind mills and wind machines) in any zoning district other then the AG and AGR districts, must be approved by special permit, which requires advertisement in the newspaper, written notice to neighbors, sign posting, and public hearing(s).

The rural AG and AGR districts currently have a condition that requires a substantial setback based on studies done in the late 1970's and early 80's. Energy costs and environmental concerns are driving the private sector to develop and offer a new generation of more efficient, smaller, shorter, and quieter wind machines that generate energy for individual residences and businesses. Home owners, businesses and industries are showing an interest. We think in certain cases, these small machines should be encouraged by allowing them without the need to obtain special permits, unless they go to heights greater than the district allows. The Planning Commission will consider a proposed set of zoning amendments that would allow these facilities as a permitted use, much like a tv or satellite dish antenna, and allow taller machines by special permit.

Study Process and Timing

Public hearings on the proposed amendment to the City zoning ordinance and County zoning resolution, City CZ08040 and County CZ08042, were held in September, 2008. The City Council and County Board approved the amendments in October.
